Entity vs EOR

Set up an entity, or hire through Peak?

For most teams entering Switzerland, an EOR is faster, cheaper and lower-risk than establishing a local entity.

Peak's honest advice

We'll tell you when setting up your own entity makes more sense. Our goal is your success, not our commission.

Staying compliant

Employment law and payroll, handled

Switzerland sits outside the EU and EEA, and tax and some pay rules vary by canton. The 13th-month salary is customary, and we keep every contract, deduction and filing correct.

Key protections we cover

  • 13th month salary: not statutory, but customary and usually agreed in the contract.
  • Notice periods: 1 to 3 months by length of service (Code of Obligations).
  • Paid leave: minimum 4 weeks per year.
  • Minimum wage: none nationally, though some cantons set one.
  • Probation: maximum 3 months, with 7 days' notice during probation (Code of Obligations).

Mistakes we prevent

  • Misclassifying contractors who should be employees.
  • Inadequate probation-period documentation.
  • Missing mandatory registrations and filings.
  • Incorrect holiday-pay and leave calculations.
